Terms and Conditions:

  1. The booking amount is only a partial payment against the full on road value of the car.
  2. It is a token amount taken to reserve a car, a specific variant/model either available in stock or expected to be available from the manufacturer in a certain time frame as shared by the representing Sales Consultant in writing
  3. The booking amount does not guarantee any type of price protection. Price and taxes prevailing at the time of invoicing will be applicable. Price of the car and the taxes can change without prior notice.
  4. In case Bird Automotive, through it’s official representative/s has chosen to deviate from the above mentioned terms and conditions, the customer should have a written communication in effect to prove the obligation of Bird Automotive created due to that specific deviation. No claim without a valid written or email approval / acceptance will be entertained.
  5. Registration / Road tax will be applicable as notified by respective State Govt. from time to time, and the rates prevailing at the time of registration of the car shall apply.
  6. BMW India reserves the right to alter or modify the configuration and specifications of a particular variant without prior notice. Bird Automotive will not be responsible for any such change effected by BMW India on or before the time of delivery of the vehicle.
  7. No further revision in special offers of any kind shall be entertained once the contract is agreed upon and duly signed.
  8. The minimum booking amount for a vehicle will be Rs. 2,00,000/- Rupees Two Lakhs. This amount will be non-refundable and will only be adjusted against the full Invoice value of the car.
  9. In case of cancellation of booking, the booking amount will not be refunded. The car reserved in the name of the respective customer will thereby be released. Any amount over and above Rs. 2 Lakhs will be refunded on receipt of a written cancellation request signed by the customer who has booked the vehicle / on the Company letter-head in case the booking has been made in the name of a Company. The cancellation request has to be submitted along with the original receipts / documents and the refund will be processed within two weeks from the date of receipt of cancellation request.
  10. In case customer does not make the balance payment within the commitment period as agreed upon, the dealer has right to cancel the allocation of the said vehicle without prior intimation or notice.
  11. Delivery of the vehicle will be made only after receipt of full payment in the bank accounts of Bird Automotive Pvt. Ltd. and upon completion of the entire documentation as well as receipt of full and final payment from Financer / Banks and or BMW India Financial Services Pvt. Ltd.
  12. The customer will make the full and final payment within 7 days after selection of the vehicle which should be in stock. The car will be delivered within 15 working days from the date of making full payment subject to completion of full documentation by the customer.
  13. In case the selected vehicle is not in dealer’s physical stock, the vehicle delivery date would be communicated in writing by Bird Automotive.
  14. In case of an auto loan is sourced directly by the customer through their bank / a preferred finance company / Direct Selling Agency / Direct Marketing Agent etc., the delivery will be made only after the full payment is received in the account of Bird Automotive Pvt. Ltd.
  15. The car will be registered in the name mentioned in the Sales Contract. Any change in the same should be intimated in writing indicating the change of Buyer’s name and the consent by both the parties. A fresh contract will have to be signed by the new buyer. The receipt of booking amount issued by Bird Automotive Pvt. Ltd. will not be changed, but can be transferred in the name of the subsequent buyer with a mutual consent. Fresh booking amount will be accompanied with the new sales contract, duly signed by the subsequent buyer.
  16. In case of any changes in Sales Contract with regard to Vehicle Model / Color / Registration, it will be done after written communication submitted by customer and a new Sales Contract will be signed accordingly. The priority for the same will be effective from the date of new Sales Contract. In case of any change in model / colour, priority will be effective from the date of receipt of request for change and also subject to availability of the vehicle in dealer’s physical stock.
  17. The vehicle shall not be delivered to any person other than the registered owner(s) and or on providing the authorization letter (on letterhead if applicable) given by the registered owners duly attested signatures and proper KYC Identification of the person taking the delivery.
  18. The delivery of the vehicle shall be given at the showroom of the dealer unless otherwise requested by the customer. If the vehicle has to be dispatched to the desired destination, at the request of the customer, it will be at absolute customer’s risk / responsibility and any cost / freight / transit insurance will be borne by the customer. The dealer shall not be responsible for any damage etc. in transit.
  19. Delivery date indicated is also subject to “Force Majeure” conditions. The term “force majeure” means any circumstances which are unusual, unforeseen and are beyond the control of BMW India Pvt. Ltd. or Bird Automotive Pvt. Ltd., the consequence of which could not have been avoided even if all due care had been exercised, including but not limited to acts of God, war or threat of war; riot; civil; strife; hospitalities; political unrest; Government action; industrial dispute; natural or other disaster; nuclear incident; terrorist activity; sabotage; blockage; embargo; weather conditions; transport strike; fire; flood; typhoon; tempest; drought; short supply of labour, fuel; raw material; or manufactured produce; or otherwise preventing or hindering the manufacturer or delivery of the car and all similar event beyond the control of BMW India Pvt. Ltd. and/or Bird Automotive Pvt. Ltd. No claims or damages in case of delay in delivery of the car due to the said unforeseen circumstances will be entertained.
  20. Any disputes shall be subject to the jurisdiction of Delhi Courts only.
  21. Registration of the vehicle will be done as per the guidelines and rules provided under the Motor Vehicle Act. 1989.
  22. Vehicle once sold and registered shall not be taken back or exchanged under any circumstances.
  23. In case of accessory fitment, the standard / replaced part will be given back to customer based on request. In case fitment of the new part / accessory involves deterioration / damage of the standard, then Bird Automotive / Manufacturer (BMW) shall not be responsible for the same.
  24. It is understood that this is contract between Bird Automotive Pvt. Ltd. and the customer and that BMW India Pvt. Ltd. will not be party to this sales contract.
  25. Any notice given hereunder must be in writing and sent by either Registered Post with acknowledgement due or by hand delivery to the dealer at the place of business of Bird Automotive Pvt. Ltd.
  26. In case of cancellation of booking, after receipt of the financed amount financed by any financial institution, the same, along with cumulative interest (if any) till the date of remittance will be refunded / reversed to the particular financial institution by debiting the customer’s account.
  27. The price of the car to be exchanged / traded-in will be determined on the date of first evaluation based on the overall condition of the car / mileage driven on the date of execution of sale / booking. Evaluation Price of the same will be valid for 7 days and / or 200 kms (whichever occurs earlier – in the same condition) from the date of evaluation.
